The Metropolitan Sewer District supervisor who gave Diana Frey a favorable job review in 2009 – at the same time that other officials complained that she seldom showed up for work – was a member of the city employees’ union that Frey headed.
Robert Merz, then a senior administrative specialist at MSD, prepared a February 2009 evaluation that rated Frey as a “valued employee” who would “lead by example” and “managed to get things done even while not in her office at MSD,” according to documents released by City Hall in response to an Enquirer request.

Merz, who recently moved from MSD to the Emergency Communications Center, is a member of Cincinnati Organized and Committed Employees – the union of middle managers that Frey led for eight years and from which she allegedly embezzled $757,009.
Merz could not be reached for comment Tuesday.
In his evaluation of Frey, Merz wrote: “Diana was involved in contract negotiations for a good portion of the year but there was no change in the quality of her work. Her work had the same professionalism it always had.” He also praised Frey’s willingness to “attack any problem head on” and said that she “treated everyone the way she wanted to be treated.”
Later in 2009, an image of Frey in stark contrast to that in Merz’s evaluation emerged in emails from another MSD supervisor – also a CODE member – who complained of Frey’s frequent unexplained absences, paucity of work and habitual failure to check with supervisors for assignments.
“Every employee here is aware that Diana hasn’t physically been here for a few years and that she hasn’t performed city work,” Dianne Bookwalter, the MSD supervisor, wrote in a Dec. 1, 2009, email.
As she showed up less and less for her $64,000-a-year job as a MSD administrative specialist, Frey increasingly devoted nearly all of her time to union business – sometimes with city consent, often without, the emails show.
Bookwalter said in a Nov. 17, 2009, email that Frey “doesn’t communicate at all anymore about where and how she spends her time.”
Two weeks earlier, Bookwalter noted in another email that Frey “does not check in with me to ask for assignments.” Frey, after briefly agreeing to spend about four hours a day, two or three days a week, on city business, “stopped without discussing it on her own,” Bookwalter added.
Under CODE’s contract, Frey was entitled to spend up to 1,000 hours a year – roughly half of her time – on union business, except in years with contract negotiations, when an additional 640 hours are allowed.
The emails make clear, however, that Frey seldom even came close to that 50-50 division of her time.
MSD was established in 1968 by Hamilton County but is operated under a 50-year contract by the city. It handles the wastewater for 230,000 residential and commercial customers in 43 of Hamilton County’s 49 jurisdictions as well as parts of Butler, Warren and Clermont counties.
Meg Olberding, a spokesman for City Manager Milton Dohoney Jr., said Tuesday that city leaders gave Frey “some leeway” in 2009 to spend extra time on union matters as City Hall went through two rounds of budget cuts involving concessions from unions.
“We were aware there were reasons she needed more time and agreed,” Olberding said. “A certain amount of goodwill building enters into that, because you’re hoping to establish some rapport with union leadership.”
Dohoney, however, was not aware that some MSD officials and others had concerns over whether Frey was abusing that leeway until the issue came to light after Frey’s indictment on a federal wire fraud charge last week, Olberding said.
When city officials would periodically talk about curbing Frey’s union hours, Olberding said, issues such as budget cuts and contract negotiations that legitimately required more of union presidents’ time complicated that effort.
“You act in good faith,” Olberding said. “And you assume that others are acting in good faith.”
Among the key goals that Dohoney gave Hilary Bohannon when he hired him in the fall of 2009 to head the city’s Human Relations Department was to develop a better rapport between the administration and unions, a relationship management believed had deteriorated before Bohannon’s arrival. Ninety percent of the city’s employees are represented by a union.
“You do give union leadership some latitude in order to develop that rapport,” Olberding said. “We live in that structure. There’s a lot of nuance in the relationship between management and labor.”
Frey formally asked for permission to do union business full-time, Olberding said, and suggested permitting union members to chip in to help pay at least part of her salary, as happens with some other unions.
The city administration, however, said no. Officials did not believe that CODE required so much time and wanted Frey to spend more hours working at MSD.
But that apparently never occurred, according to payroll records released by Dohoney spokeswoman Tiffaney Hardy.
The records show that since March, when a new CODE contract was signed, Frey was paid for 456 hours of union time, 120 hours of vacation, 40 hours of sick time, 16 hours for holidays and eight hours as a personal day – but no “MSD work hours.”
Frey is in the process of resigning, city officials say.

Lokayukta’s report on illegal mining: Main point – Express Buzz
BANGALORE: Karnataka Chief Minister B.S. Yeddyurappa, four ministers, former chief minister H.D. Kumaraswamy and 787 officials should be tried for graft, state Lokayutka (ombudsman) N. Santosh Hegde recommended Wednesday.
All those named in the 25,228-page report should be tried under various laws like the Prevention of Corruption Act and the Forest Act, said Hegde, whose term as Lokayukta ends Aug 2.
He recommended cancelling of licenses of mining firms found involved in illegal mining and transactions and also recovery of four times the value of the loss caused by them to the state exchequer.
The following are the main points of his report, which says between 2006 and 2010 illegal mining has caused the state a loss of Rs.16,085 crore.
** Try Yeddyurappa for graft because a trust run by his sons received Rs.10 crore donation from an iron ore mining firm that was financially not in a sound position. The sons also sold one acre land near Bangalore, whose market value was Rs.1 crore, for Rs.20 crore to a mining firm – the two incidents clearly establishing graft.
** Mining barons and ministers Reddy brothers — Tourism Minister G. Janardhana Reddy and Revenue Minister G. Karunakara Reddy — claim not being involved in mining in Karnataka. This is false. Enough evidence to prove them wrong.
** Their associate and Health Minister B.Sriramulu also involved and should be tried.
** Yeddyurappa loyalist and Housing Minister V. Somanna’s wife involved in illegal mining business.
** Former chief minister and Janata Dal-Secular state president H.D. Kumaraswamy granted two mining leases, flouting rules. Should be prosecuted.
** Congress Rajya Sabha member and mining baron Anil Lad’s wife involved in illegal mining. To be tried.
** BJP legislator B. Nagendra also involved. To be tried.
** Total number of officials to be tried – 787.
** Number of companies named in the report – over 100.
** Files perused – 400,000
** Entries examined – 50 lakh (five million).
** Illegalities found – mining in larger areas than permitted; exporting with fake documents; overloading of trucks; encroachment of forest areas.
** Separate chapter on the situation in iron-ore rich district of Bellary, about 300 km from Bangalore. Bellary is the Reddy brothers’ stronghold.
** Interim report on illegal mining given in Dec 18, 2008. No action from the government except filing cases against 55 firms.
